2.How Do We Collect Your Personal Data and What Are the Legal Grounds?

In all of our personal data processing activities, we act in compliance with all obligations and principles required by the relevant legislation, primarily the Personal Data Protection Law (KVKK), and take the necessary security measures to ensure the secure processing of your personal data. According to the KVKK, we collect your personal data through the methods listed below and any other channels that may be added in the future, either automatically or non-automatically, in voice, written, or electronic form, and process it in accordance with the purposes of processing under articles 5.1, 5.2, 6.2, and 6.3 of the KVKK.

• All production, sales, and marketing activities managed under the company brand names established or produced by COMFORMAC Chemistry Industry INC.
• These activities are carried out through accounts operated on various social media channels on behalf of COMFORMAC Chemistry Industry INC. (“Social Media”).

3.What Personal Data Do We Process?

The personal data you have provided to us: First and last name, date of birth, Turkish ID number, phone number, email address, address, surveys, and photo and video recordings shared within the scope of our agreement, as well as any other data shared with us through the channels mentioned above.

Personal data collected automatically: Data collected automatically through search engines, image and sound recording devices, cookies, or other means.

Personal data obtained from other sources: Updated delivery and address information, account details, purchase information, page viewing data, search terms and search results, and data such as paid listings (e.g., Sponsored Links) shared with us by our social media tools, business partners, suppliers, and other third parties based on your prior consent.

4.What Purposes Do We Process Your Personal Data?

We generally process your personal data based on your explicit consent. However, in exceptional cases permitted under the KVKK, your personal data may be processed without your explicit consent (KVKK Article 5.2 and Article 6.3). In this context, we process your personal data for the following purposes: (i) to fulfill our legal obligations, (ii) in case you are unable to provide consent due to physical impossibility, (iii) to provide the products and services ordered or purchased through our websites, including contacting you when necessary, facilitating the purchase and sale transactions of COMFORMAC Chemistry Industry INC. businesses, using POS, processing returns, providing shipping services, establishing distance sales contracts in the context of electronic commerce, selling and delivering products or services, receiving and responding to your questions and complaints, and using this data in case of potential disputes, (iv) to protect our legitimate interests such as cost reduction, efficient use of resources, monitoring service quality and customer satisfaction, as long as it does not harm your fundamental rights and freedoms.

Additionally, we may process your personal data that you have made public through means such as communications and social media channels, without requiring further consent, to the extent permitted by the KVKK.

If we obtain your explicit consent (KVKK Article 5.1 and Article 6.2), the personal data collected through the aforementioned channels and methods may be processed for the following purposes: (i) to provide you with personalized product and service opportunities such as internet advertising, targeting, re-targeting, cross-selling, campaigns, opportunities, and service advertisements, including the use of cookies, making commercial offers based on your preferences and recent purchases, (ii) to determine how you learned about our websites, generate non-anonymous traffic statistics based on unique user registration, enhance your website visit experience, increase the functionality of the websites, recognize you during your visit, and provide content tailored to your expectations and interests, as well as personalized browsing opportunities, including the use of cookies. Additionally, during your visit to the COMFORMAC Chemistry Industry INC.  headquarters, your usage habits may be tracked based on previous records to offer you personalized products, (iii) to carry out production, sales, and marketing activities, including providing special advertisements, campaigns, benefits, and other advantages for you, and conducting marketing and CRM (Customer Relationship Management) activities, including the use of cookies, (iv) to create new product and service models, including the use of cookies, (v) to send electronic commercial communications (such as campaigns, newsletters, customer satisfaction surveys, product and service advertisements), (vi) to send gifts, promotional items, and periodical publications (e.g., magazines), (vii) to organize corporate communications, events, and invitations, and provide information about them.

Additionally, your Sensitive Personal Data may also be processed with your explicit consent, for the purposes outlined in Article 5.2 of the KVKK and for the purposes from (i) to (vii) mentioned above.

5.What is the retention period for your personal data?

Your personal data will be processed in accordance with the regulations on the protection of personal data, including the KVKK, and in compliance with the mandatory retention periods prescribed by relevant legislation. In any case, your personal data will continue to be processed as long as the legitimate purposes outlined above persist.

6.Transfer of your personal data to third parties or abroad

Your personal data may only be transferred to third parties, both domestically and internationally, in the presence of processing purposes that do not require your explicit consent. This may include storage, archiving, IT support (servers, hosting, software, cloud computing), security, call center services, and other third parties from whom we receive support in areas such as group companies, business partners, suppliers, banks, financial institutions, legal, tax, and other consulting firms in relevant fields, as well as authorized institutions and organizations, especially in countries like the EU, the USA, the UK, OECD countries, India, China, and Russia.

Furthermore, your personal data may be transferred to group companies or third parties located in the countries mentioned above and who provide marketing and sales support, based on your explicit consent.

Additionally, with your explicit consent, in the event that a part of or assets owned by COMFORMAC Chemistry Industry INC. including but not limited to trademarks, domain names, and other commercial elements) are sold, your personal data may be transferred to the acquiring individual or legal entities, their stakeholders, business partners, agents, and consultants, both domestically and internationally, to the extent required by the transfer. During the process, your data may be processed by these third parties only for the necessary evaluation. Upon the transfer, the acquiring party may continue processing your personal data, as the new data controller, along with the transferred assets.

7.Your Rights Under the KVKK Regarding Your Personal Data and Our Support as the Data Controller

Pursuant to article 11 of the KVKK, by applying to the company, you have the right to:

• Request information about whether your personal data has been processed,
• Learn the purpose of processing your personal data and whether it is being used in accordance with that purpose,
• Know the third parties to whom your personal data has been transferred, either domestically or internationally,
• Request the correction of your personal data if it is incomplete or inaccurate,
• Request the deletion or destruction of your personal data if the reasons for processing no longer exist, in accordance with the principles of purpose, duration, and legitimacy,
• Request that any corrections, deletions, or destructions of your personal data be communicated to third parties to whom your data has been transferred,
• Object to a decision that has been made about you based solely on automated processing of your personal data, which results in a negative outcome,
• Request compensation for damages if your personal data has been processed unlawfully and you have suffered harm as a result.

In this regard, you can submit your requests regarding your rights by filling out the application form above and sending it to the email address below. Upon your request, you must send your application form either securely signed with an electronic signature to the designated e-mail address with a “KEP” extension, or send it to the postal address below along with identification documents in hard copy with your wet signature or via notary. The company will respond to your request as soon as possible, and at the latest within 30 days, free of charge, after receiving the relevant documents. If fulfilling your request incurs a cost, we may only charge you the fees determined by the Personal Data Protection Authority in accordance with its tariff.
